1. Definitions

App – the Real Food Rating mobile application.
Company / We / Us – Real Food Rating Pty Ltd (ABN 14 688 565 568).
User / You – any person who downloads, accesses, or uses the App.
Content – all information, data, text, images, ratings, algorithms, and materials made available through the App.
Subscription – the paid access plan to premium features of the App.
FSANZ – Food Standards Australia New Zealand.
Real Food Certification – a fee-for-service programme involving independent assessment against published criteria and a 12-month licensing agreement for use of the Real Food Certified™ badge.

2. Acceptance of Terms

By downloading, accessing, or using the App, you agree to be bound by these Terms of Service (“Terms”).
 If you do not agree, you must not use the App.

You represent and warrant that:
 • You are at least 18 years of age (or are using the App under the supervision of a parent or guardian who agrees to these Terms and is responsible for your use);
 • You are legally capable of entering into binding contracts; and
 • Your use complies with all applicable laws and regulations.

These Terms do not exclude, restrict, or modify any rights you may have under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)).

3. Description of Service

The Real Food Rating App provides:
 • Food-product ratings based on ingredient analysis;
 • Information about food additives and preservatives;
 • Product comparison and scanning tools;
 • Ingredient-list analysis; and
 • Educational content about additives and nutrition.

The App provides general educational information only and does not constitute medical, nutritional, or health advice. Always seek guidance from a qualified health professional for personal health concerns.

Products carrying the Real Food Certified™ badge have met strict, published criteria and appear in a separate, clearly identified section of the App.

3.1 Camera Access and Barcode Scanning

The App requires camera access to scan product barcodes. Camera access is used solely for barcode recognition and product identification. We do not store, transmit, or analyse photos or images captured during scanning. You may revoke camera permissions in your device settings at any time, though this will prevent barcode-scanning functionality.

3.2 Internet Connection

An internet connection is required to scan products and access our product database. Some features may have limited offline functionality.

No Endorsement. Inclusion of a product within the App (certified or not) does not constitute endorsement or partnership beyond the disclosures in our Disclaimer & Disclosure.

4. Information Accuracy and Limitations

4.1 General Information

We use reasonable efforts to ensure accuracy, but we do not warrant that:
 • Information is complete, accurate, or current;
 • Content is free from errors, omissions, or defects; or
 • Product formulations reflect current packaging.

4.2 Product Information

You acknowledge that:
 • Product ingredients and formulations may change without notice;
 • Ratings are based primarily on ingredient lists, not full nutrition panels;
 • You should always check the product label before purchase or consumption; and
 • Ratings reflect our proprietary algorithm and are not universal health standards.

4.3 Additive Library

Additive and preservative information has been researched by qualified health and science professionals using reputable sources (including FSANZ). It is provided as a guide only and may be updated as new evidence emerges.

4.4 Paid Certification and Placement Transparency

Certain certified products appear as part of our Real Food Certification programme, a fee-for-service programme with a 12-month licensing agreement. Certified brands (rated 4 or above out of 5) may also appear in sponsored recipe placements, which are clearly labelled within the App. Certification and paid placements do not influence the App’s core rating algorithm or product scores. 5. Not Medical or Nutritional Advice

You acknowledge that the App does not provide medical or dietary advice and that individual responses to foods and additives vary. Always consult a qualified professional for personalised guidance.

6. Proprietary Rating System

Our rating system is proprietary and based on ingredient analysis, additive data, and processing classification. Ratings are intended as general guidance and may evolve as our methodology improves. They do not replace reading labels or seeking professional advice.

7. User Responsibilities

You agree to:
 • Use the App for lawful, personal purposes only;
 • Verify all product information independently;
 • Seek professional medical advice for health or dietary concerns;
 • Not misuse, hack, reverse engineer, or attempt unauthorised access to the App;
 • Not reproduce, distribute, or create derivative works from the Content without written permission;
 • Not submit, upload or share unlawful, defamatory, or misleading content; and
 • Not use bots, scrapers, or other automated means to access, query, or copy the App or its databases.

7.1 User Submissions and Feedback

If you submit feedback, product corrections, error reports, or other content to us through the App or by email, you grant Real Food Rating Pty Ltd a perpetual, worldwide, royalty-free licence to use, reproduce, modify, and display that content for App improvement and educational purposes. You represent that you own or have the right to submit such content and that your submissions do not violate any third-party rights.

8. Subscriptions and Payments

8.1 Subscription Plans

Premium features may require a paid subscription (monthly or annual). Prices are displayed in the App and store listings.

8.2 Billing & Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current term. Charges are processed through your Apple or Google account. Manage or cancel via your store settings.

8.3 Free Trials

If a free trial is offered, valid payment details are required to activate it. Subscription automatically begins after the trial unless cancelled before expiry. Only one trial per user.

8.4 Price Changes

We may change prices with reasonable notice. Continued use after changes constitutes acceptance. If required by law, users will be notified of any price changes in advance through the App or by email.

9. Refunds

Purchases are processed by Apple or Google; refund requests must be submitted through the respective store. Subscriptions are generally non-refundable once access is granted. We may offer a discretionary refund only in cases of proven technical error.
 Nothing in this clause affects your rights under the Australian Consumer Law.

10. Intellectual Property

All Content, software, database structures, algorithms, text, images, graphics, trademarks, and design elements are the property of Real Food Rating Pty Ltd or its licensors.
 You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.
 You may not copy, modify, sell, or reverse engineer any part of the App.
 The Real Food Rating®, Real Food Certified™, and Reclaiming Real Food™ names and logos are registered or pending trademarks of Real Food Rating Pty Ltd.

11. Privacy and Data Security

Your use of the App is subject to our Privacy Policy (https://www.realfoodrating.com/privacy-policy). We collect and process personal information in accordance with that policy and apply reasonable safeguards to protect your data; however, no method is entirely secure, and you use the App at your own risk.

12. Third-Party Content and Links

The App may display third-party products or links to third-party websites. We do not control or endorse them. Interactions with third parties are solely between you and those parties.

13. App-Store Terms and Third-Party Beneficiaries

You acknowledge that these Terms are between you and Real Food Rating Pty Ltd, not Apple Inc. or Google LLC. Apple and Google have no responsibility for the App or its content but are third-party beneficiaries of these Terms and may enforce them against you.

14. Disclaimers

To the maximum extent permitted by law:
 • The App and its Content are provided “as is” and “as available.”
 • We make no warranties, express or implied, including merchantability, fitness for purpose, or non-infringement.
 • We do not guarantee uninterrupted or error-free operation.
 • We do not warrant the accuracy or completeness of Content.
 • We make no representation that all data or product information complies with FSANZ updates in real time.

15. Australian Consumer Law Guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a refund or replacement; for minor failures you are entitled to have the service re-supplied or to be compensated for any reduction in value. Nothing in these Terms limits those rights.

16. Limitation of Liability

To the maximum extent permitted by law:
 • We are not liable for any indirect, incidental, special, consequential, or punitive damages, loss of profits, data, or health impacts arising from your use of the App.
 • Our total liability for all claims shall not exceed the amount you paid in subscription fees during the 12 months prior to the claim or AUD $100, whichever is greater.
 • Nothing in these Terms limits your rights under the Australian Consumer Law. If required under the ACL, our liability is limited to (a) resupplying the App service; or (b) paying the cost of having it resupplied.

17. Indemnification

You agree to indemnify and hold harmless Real Food Rating, its officers, employees, and agents from all claims, losses, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the App.

18. Availability and Changes

We may modify, update, suspend, or discontinue the App or any feature at any time. We do not guarantee that the App will always be available or uninterrupted and are not liable for any such modification or discontinuation.

19. Termination

We may suspend or terminate your access if you breach these Terms or applicable law, engage in fraudulent or harmful activity, or if required by law or we cease offering the App. You may delete your account or uninstall the App at any time. Termination does not entitle you to refunds except as required by law.

19.1 Account Deletion and Data Retention

You may request deletion of your account at any time by contacting us at support@realfoodrating.com.au or through the account settings within the App. Upon receiving your deletion request, we will remove your personal data in accordance with our Privacy Policy and applicable laws, typically within 30 days. Some information may be retained where required by law or for legitimate business purposes (such as resolving disputes or enforcing these Terms).

20. Dispute Resolution

Before commencing legal action, please contact us at support@realfoodrating.com.au to attempt informal resolution.
 These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales.
 For privacy-related disputes, you may also contact the Office of the Australian Information Commissioner (OAIC): www.oaic.gov.au.

21. General Provisions

Entire Agreement: These Terms and the Privacy Policy form the entire agreement between you and us.
 Severability: If any provision is invalid or unenforceable, we will replace it with a valid provision that most closely reflects our intent, and the remainder remains in effect.
 Waiver: Failure to enforce any right is not a waiver of that right.
 Assignment: We may assign our rights; you may not assign yours without consent.
 Force Majeure: We are not liable for events beyond our reasonable control.
 No Partnership: These Terms do not create an employment, partnership, or agency relationship.
 Contact Updates: We may update our contact details from time to time; the current version will always be available in the App and on our website.
 Commercial Disclosure: Real Food Certification is a fee-for-service programme involving 12-month licensing agreements. We may also offer paid promotional services (such as sponsored recipes or social media partnerships) to certified brands with a Real Food Rating of 4 or above. These commercial services affect visibility and marketing presentation only and do not alter algorithmic ratings or editorial content.  Changes to Terms: We may update these Terms from time to time. Material changes will be notified through the App or by email. Changes take effect immediately upon posting for new users, and 30 days after notification for existing users. Continued use after changes constitutes acceptance.
