Definitions

Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth) (as amended from time to time). Customer means the party who uses, accesses or subscribes to any Real Food Rating Platform. Material means all information, data, product evaluations, reviews, and educational content available on or through the Real Food Rating Platforms. Real Food Rating means the Real Food Rating initiative founded by Mandy Sacher and its related entities. Real Food Rating Platforms include but are not limited to the Real Food Rating website, app, social media, downloadable resources, and any other formats or media through which Real Food Rating distributes content or offers services. Terms refers to these Terms of Trade and Use.

Use of Material

All Material on the Real Food Rating Platforms is provided for general educational and informational purposes only. It is not intended as personalised medical, nutritional, or health advice. Users should book in for a private nutritional consultation or with a qualified professional before making dietary changes or relying on product recommendations, especially when dealing with allergies, intolerances, or health conditions.

Although Real Food Rating endeavours to provide accurate and up-to-date content, we make no guarantees about the completeness, reliability or accuracy of the information.

Health, Nutrition and Product Guidance

Customers acknowledge that:

• All product reviews and food ratings reflect general criteria based on ingredient quality, additive content, processing levels, and wholefood values, not personal health status or dietary needs.
• Real Food Rating is not a substitute for medical or dietetic consultation.
• Ingredient lists and formulations may change over time, and it is the Customer’s responsibility to check the most current information on packaging before consumption or purchase.

Additive and Ingredient Information

Additive and preservative insights are provided as a guide only and are based on independent research and sources including the EFSA and FSANZ. While efforts are made to maintain accuracy, Real Food Rating does not provide any warranty in relation to this information and encourages users to seek professional advice where required.

Product Pricing and Availability

Any pricing, availability, or discount information is indicative only and may vary between stores, locations, and over time. Real Food Rating does not guarantee current pricing or stock status.

Errors and Omissions

While care is taken, information on the Real Food Rating Platforms may contain typographical errors, inaccuracies, or omissions. Real Food Rating reserves the right to correct such errors as they become known.

Intellectual Property

All content on the Real Food Rating Platforms, including the rating system, icons, images, methodology, and written materials, is the intellectual property of Real Food Rating and Mandy Sacher Consulting unless otherwise stated.

You may use the Platforms for personal, non-commercial purposes only. No content may be reproduced, shared, sold, licensed, or distributed without prior written permission.

Third-Party Products

We may reference or display products made by third parties. This does not imply affiliation, endorsement, or warranty unless explicitly stated.

Refund Policy

Customer Acknowledgements

By using any Real Food Rating Platform, the Customer confirms that they:

• Are legally capable of entering into a binding agreement.
• Have read and understood these Terms.
• Accept that all recommendations are general in nature and not a replacement for medical guidance.

Limitation of Liability

To the maximum extent permitted by law:

• Real Food Rating is not liable for any injury, illness, loss, or damage arising from the use of our Platforms or reliance on the Material.
• We make no warranties, express or implied, about the completeness or fitness-for-purpose of the information provided.
• Where required by Australian law, our liability is limited to re-supplying the service or refunding the cost of the service.

Indemnity

The Customer agrees to indemnify and hold harmless Real Food Rating and its directors, contributors, employees, and agents from any claims or liabilities arising from misuse of the Platforms, breach of these Terms, or reliance on the Material.

Changes to Terms

These Terms may be updated from time to time without notice. Continued use of the Platforms after changes constitutes acceptance of the revised Terms.

Jurisdiction

These Terms are governed by the laws of New South Wales, Australia, and any disputes must be brought before the courts of that state.
